2.Efectele ei sunt în sensul interpretării de către magistrați a prevederilor din Codul penal privind abuzul în serviciu.
Cu alte cuvinte, Curtea NU A CONSTATAT NECONSTITUȚIONALITATEA art. 297 din Codul penal, ci, dimpotrivă, CONSTITUȚIONALITATEA lui, și a stabilit, de asemenea, în ce mod trebuie interpretat acest articol.
